Can I Cancel a Timeshare Directly with the Resort?

Can I Cancel a Timeshare Directly with the Resort?

Mexico is one of the most popular countries in the world offering timeshare and vacation club membership. The best timeshare developers concentrate on providing timeshare and vacation club membership at popular destinations such as Riviera Nayarit, Mazatlán, Puerto Vallarta, Cozumel, Cancun, Riviera Maya, and Los Cabos–just to mention a few. These vacation destinations have become very popular with people looking for a second home, which is why timeshare developers are always looking for new features and benefits to provide members. However, as great as your timeshare might be, you may wonder whether you can actually cancel a timeshare directly with the resort.

This article will address the following questions:

  • Can I cancel a timeshare directly with the resort?
  • Is it even possible to cancel a timeshare?
  • What are my consumer rights with regard to a timeshare?
  • Can I cancel a timeshare after the cooling-off period has expired?
  • Do I need to hire a lawyer that specializes in how to cancel a timeshare to assist me?
  • Will I lose out if I cancel a timeshare?

Let’s look at these questions one by one.

Can I cancel a timeshare directly with the resort?

The answer will depend on the resort where you purchased your timeshare and whether there is a separate operating company that manages your timeshare. But, in essence, IF you qualify for being able to cancel a timeshare, you should be able to do so directly with the resort.

Is it even possible to cancel a timeshare?

You may only cancel a timeshare during the rescission period (otherwise known as the cooling-off period) after you have purchased the timeshare membership and the contract has been signed. You should look through the contract or contact the resort where you purchased your timeshare membership to see how long the rescission period is. It is always best to contact the resort first to see if there is a way to resolve your reasons for considering cancelling your timeshare. Most people decide not to cancel their timeshares once they touch base with members services.

What are my consumer rights with regards to a timeshare?

As a consumer, you have rights. For example, your contract should reflect the reality of your timeshare membership, and should provide a cooling-off period. The cooling-off period actually protects both the consumer and the timeshare company, which should put your mind at ease if you are unsure whether to buy a timeshare. During the cooling-off period, it is possible to cancel a timeshare directly with the resort.

Can I cancel a timeshare after the cooling-off period has expired?

The best way to answer this question is with another question. Would you expect to get a refund on a suit you bought in a store after the time allotted for refunds has expired? Even if the suit was faulty, you would have to return it within a certain amount of time for the refund to be valid, right? In most western countries, Mexico included, you are not automatically entitled to a refund just because you changed your mind about a purchase.

Do I need to hire a lawyer that specializes in timeshare to assist me?

No, there is no need to hire a lawyer to cancel a timeshare directly with the resort. In fact, you should beware of fraudulent companies that say they have lawyers who work with timeshare companies to cancel your timeshare membership. Once the rescission period is over, you cannot cancel your timeshare membership legally, no matter how much you pay your lawyer (and, let’s be honest here, they will be more than happy to receive your money). These fraudulent companies also say that they specialize in cancelling timeshare memberships with a no-obligation consultation beforehand. It won’t be long before you will be asked to pay a hefty fee to cancel a timeshare that cannot be cancelled.

Why do People Keep Falling for Timeshare Cancellation Scams?

These fraudulent cancellation companies offer you the impossible, and they are very convincing. This is why so many people are fooled by Mexican timeshare cancellation scams. Fraudulent cancellation companies will tell you exactly what you want to hear. Once you have paid them a big fee and you think your timeshare membership has been cancelled, they are gone. You believe your timeshare membership is cancelled, but when you call the resort, you realize that not only are you still a member, but now you are also in default on your payments and/or maintenance fees. You are legally bound to pay these fees, and you will not be able to use your timeshare until you are up to date.

After the rescission period has passed, you are not legally able to cancel your timeshare membership. If anyone tells you a different story, then they are lying and trying to scam you. The best advice is to try to cancel a timeshare directly with the resort; or, better still, find out how to use and enjoy your timeshare.
